1. Introduction and Acceptance

These Terms & Conditions govern your access to and use of www.bagbastaindustries.shop and any purchase made through it. The Website is operated by Bagbasta Industries

By accessing the Website, creating an account or placing an order, you confirm that you have read, understood and agreed to these Terms, our Privacy Policy and our Return & Refund Policy, which form part of this agreement. If you do not agree, please do not use the Website.

2. Eligibility

You must be at least 18 years old, or use the Website under the supervision of a parent or legal guardian, to place an order. By placing an order, you confirm that the information you provide is true, accurate and complete.

3. Products and Descriptions

We make every effort to display our products, including colours, sizes, materials and images, as accurately as possible. However, actual colours may vary slightly depending on your screen settings and lighting, and minor variations in handmade or manufactured products are normal. These variations are not considered defects.

All products are subject to availability. We reserve the right to modify, discontinue or limit any product at any time without notice.

4. Pricing

All prices are listed in Pakistani Rupees (PKR) unless stated otherwise.
Prices may change at any time without prior notice. The price at the time you place your order is the price that applies to that order.
Delivery charges, where applicable, are shown at checkout before you confirm your order.
We reserve the right to correct pricing or listing errors. If an order was placed at an incorrect price, we may cancel it or contact you to confirm the correct price before dispatch.

5. Orders and Acceptance

Placing an order is an offer to purchase. It is not accepted until we confirm it by email, SMS, call or WhatsApp, or dispatch the goods.
We may confirm your order by phone or WhatsApp before dispatch. Please keep your phone reachable.
We reserve the right to refuse, limit or cancel any order for reasons including stock unavailability, pricing errors, suspected fraud, incorrect or incomplete details, or an unreachable customer.
Please check your order details carefully before submitting. We are not responsible for errors in the information you provide.

6. Payment

We accept the following payment methods:

Cash on Delivery (COD)
Mobile wallets: JazzCash and Easypaisa
Bank transfer
Debit/credit card through secure third-party payment gateways

Prepaid orders (wallet or bank transfer): the order will be processed after we verify your payment. Please send your payment proof and order number on WhatsApp if requested.

Cash on Delivery: payment must be made in full to the courier at the time of delivery. Repeated refusal of COD parcels may result in future orders being declined or requiring advance payment.

Card payments are processed by third-party payment providers. We do not store your full card details. We are not responsible for failed transactions caused by your bank, card issuer or payment provider.

7. Shipping and Delivery

We deliver within Pakistan only.
Orders are dispatched through courier partners such as TCS, Leopards, Trax, PostEx or similar services.
Delivery times shown are estimates, not guarantees. Delays can occur due to courier operations, weather, public holidays, remote locations, strikes or other circumstances beyond our control. We are not liable for such delays.
You must provide a complete and accurate delivery address and a working phone number. If a parcel is returned because of a wrong address, an unreachable number or refusal without valid reason, we may charge the delivery and return costs on your next order.
Risk of loss passes to you once the parcel is delivered to the address you provided. Please inspect the parcel on delivery and follow the claim procedure in Section 8.

8. Returns, Refunds and Claims

All returns, replacements and refunds are governed by our Return & Refund Policy. In summary:

Claims must be reported on WhatsApp on the same day as delivery, and within three (3) days of the delivery date.
A complete, continuous and unedited unboxing video, starting before the parcel is opened and showing the sealed package and shipping label, is mandatory. Claims without it cannot be accepted.
Only damaged, defective, incorrect or incomplete items are eligible.

9. Cancellations

You may request cancellation before your order is dispatched by contacting us on WhatsApp or email. Once the parcel has been handed to the courier, it cannot be cancelled. We may cancel an order at any time for the reasons listed in Section 5, and any amount you have paid will be refunded.

10. User Accounts

If you create an account, you are responsible for:

Keeping your login details confidential
All activity that takes place under your account
Notifying us promptly of any unauthorised use

We may suspend or close accounts that violate these Terms or are used fraudulently.

11. Acceptable Use

When using the Website, you agree not to:

Use the Website for any unlawful or fraudulent purpose
Provide false, misleading or another person's information
Place fake, repeated or abusive orders
Attempt to hack, disrupt, scrape or overload the Website or its servers
Introduce viruses, malware or harmful code
Copy, reproduce or exploit any part of the Website without our written permission
Harass, threaten or abuse our staff, customers or courier partners

We may block access and take legal action against any violation.

12. Intellectual Property

All content on the Website, including the name "Bagbasta Industries", logos, product designs, images, photographs, graphics, text and layout, is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify or use any of it for commercial purposes without our prior written consent.

13. Customer Reviews and Submissions

If you submit reviews, comments, photos or other content, you grant us a non-exclusive, royalty-free, worldwide right to use, display and reproduce it on our Website and marketing channels. You confirm that your content is truthful, lawful and does not infringe anyone's rights. We may remove any content that is offensive, false or inappropriate.

14. Promotions, Discounts and Vouchers

Promotional offers, discount codes and vouchers are subject to their specific terms. Unless stated otherwise, they cannot be combined, exchanged for cash or applied to past orders. We may withdraw or modify any offer at any time and may cancel orders where a promotion has been abused.

15. Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information. By using the Website, you consent to those practices.

16. Disclaimer of Warranties

The Website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, express or implied, that the Website will be uninterrupted, error-free or free from viruses, or that all information on it is complete or current.

17. Limitation of Liability

To the fullest extent permitted by law, Bagbasta Industries, its owners, employees and partners shall not be liable for any indirect, incidental, special or consequential loss or damages arising from your use of the Website or our products. Our total liability for any claim relating to an order shall not exceed the amount you paid for that order. Nothing in these Terms limits any rights you have under applicable consumer protection law that cannot be excluded.

18. Force Majeure

We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, floods, strikes, riots, government restrictions, courier disruptions, internet or power failures, pandemics or political unrest.

19. Third-Party Services and Links

The Website may use or link to third-party services, including Shopify, payment gateways, couriers and social media platforms. We are not responsible for their content, availability or practices, and your use of them is subject to their own terms.

20. Indemnity

You agree to indemnify and hold harmless Bagbasta Industries from any claims, losses, damages or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, or your violation of any law or third-party rights.

21. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy and Return & Refund Policy, form the entire agreement between you and us regarding your use of the Website. Our failure to enforce any provision is not a waiver of our rights.

22. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with a revised "Last Updated" date. The Terms in force at the time you place an order apply to that order. Your continued use of the Website means you accept the updated Terms.

23. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. We encourage you to contact us first to resolve any concern amicably. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the competent courts of Pakistan.
